Surrogacy in Canada is well-established and is a popular choice for international parents because of its excellent healthcare system and IVF facilities, surrogate support, professionalism, and robust legal frameworks.

However, it’s important to note that Canadian law permits altruistic surrogacy only. Under the Assisted Human Reproduction Act (AHRA) in Canada, egg donors cannot be paid to donate their eggs, but they can be fully reimbursed for all expenses incurred during the egg donation and retrieval process. Likewise, surrogates cannot be paid, but they can be compensated for out-of-pocket expenses such as maternity clothes, medication, or reimbursement for time spent off work. Under these regulations, it is illegal to pay, offer to pay or advertise the payment to a third-party company to arrange the services of a surrogate mother.

Altruistic (unpaid) surrogacy differs from commercial surrogacy, a type prevalent in countries such as the United States, Georgia and Ukraine, where a compensation package is put in place for the surrogate mother to compensate for her services beyond the reimbursement of out-of-pocket expenses. Assisted Human Reproduction Act (AHRA) in Canada criminalises commercial surrogacy.
